If you are requesting relief for more than one tax year, you only need to file one Form IT-285. There are three types of relief: innocent spouse relief, separation of liability, and equitable relief. An explanation of each type of relief is given on page 2.

Statewide Offset Program (SWOP) If you have outstanding debt with a New York State agency, we may offset your New York State tax refund to pay all or part of your debt. Agencies your refund could be offset to include, but are not limited to: City University of New York (CUNY)

If your employer has withheld Social Security or Medicare taxes in error, follow these steps: Request a refund from your employer. You must first request a refund of these taxes from your employer. If your employer is able to refund these taxes, no further action is necessary.

There's a space on your income tax return that you can use to claim excess paid OASDI tax, giving you a refund of the overpaid amount.

In this scenario, both of your employers may have withheld too much of your pay for Social Security tax. To correct this, you may be able to claim the excess OASDI tax on your income tax return to receive a refund.

To request an exemption, you must fill out IRS Form 4029.

OASDI is part of FICA, the taxes that fund Social Security and Medicare. FICA stands for Federal Insurance and Contributions Act. If you're an employee, 6.2% of your paycheck goes toward OASDI – which your employer matches – and is sent to the federal government to help fund Social Security.

BFS will send you a notice if an offset occurs. The notice will reflect the original refund amount, your offset amount, the agency receiving the payment, and the address and telephone number of the agency. BFS will notify the IRS of the amount taken from your refund once your refund date has passed.
